FAQs

Trademark & Patent Registration FAQs

01How long does trademark registration take in Pakistan?

There is no single guaranteed registration period. An application must pass through the applicable examination and publication stages, and the overall timeframe can be affected by objections, opposition proceedings, correspondence with the Registry and processing time.

02What is the difference between a trademark and a patent?

A trademark primarily distinguishes the goods or services of one business from those of others. A patent protects qualifying inventions and gives the patent proprietor statutory rights for the period and subject to the conditions provided by law. Copyright protects qualifying original creative works.

03Should I search a trademark before filing it?

Yes. A clearance search can identify earlier marks that may create a conflict and can help determine whether the proposed mark should be modified or whether additional legal analysis is required before filing.

04Can an unregistered trademark be protected in Pakistan?

An unregistered mark may, depending on the circumstances, receive protection through the law of passing off or other applicable rights. However, registration creates a statutory trademark right and can provide a stronger basis for enforcement. The Trade Marks Ordinance expressly preserves certain earlier rights, including rights arising under the law of passing off.

05Can a foreign company register a trademark or patent in Pakistan?

Foreign applicants can seek protection in Pakistan subject to the applicable legislation, procedural requirements and representation arrangements. Where a priority claim is involved, the relevant international filing and priority requirements must also be satisfied.

06Does copyright need to be registered before protection exists?

Copyright protection and copyright registration are legally different concepts. The existence of copyright does not simply depend on obtaining a trademark-style registration certificate. Registration or recordal can nevertheless provide useful documentary evidence concerning the work and claimed ownership.

07Can I register a product design separately from a patent?

Potentially, yes. Patent protection and industrial design protection address different aspects of intellectual property. A patent concerns qualifying inventions, while registered design protection concerns the appearance or design of a product. The correct route depends on the nature of the product and the rights being claimed.

08What should I do if another business is using my registered trademark?

The appropriate response depends on the registration, the nature of the competing use, the evidence and the applicable enforcement route. Legal options can include a formal notice, proceedings concerning infringement or cancellation, and other remedies available under the applicable law.

Trademark & Patent Registration in Pakistan

A business name, logo, product design, invention or original creative work can represent significant commercial value. Protecting that asset requires identifying the correct type of intellectual property protection and following the applicable registration or enforcement procedure.

In Pakistan, intellectual property administration is coordinated through the Intellectual Property Organization of Pakistan (IPO-Pakistan), with separate offices and registries dealing with trademarks, patents and copyright. The principal legislation includes the Trade Marks Ordinance, 2001, Patents Ordinance, 2000, Copyright Ordinance, 1962 and Registered Designs Ordinance, 2000.

Sindh Lawyer assists businesses, entrepreneurs, companies, inventors, creators and foreign applicants with IP registration, filing, prosecution and related proceedings in Pakistan.

Trademark Registration and Brand Protection

Trademark protection is governed principally by the Trade Marks Ordinance, 2001 and the applicable rules. A trademark may include a brand name, logo, device, word, slogan or other mark capable of distinguishing the goods or services of one undertaking from those of another.

Before filing, a proper availability and conflict search is important. A search can identify earlier marks that may create objections or opposition risks and can also help determine the appropriate classification of the goods or services.

After filing, the application goes through the prescribed examination process. Where the application proceeds to advertisement, it is published in the Trade Marks Journal, giving interested parties an opportunity to oppose registration within the applicable statutory period.

Sindh Lawyer can assist with trademark clearance, application preparation, examination objections, opposition matters, renewal, assignment and related recordal work.

Patent Filing and Protection for Inventions

Patent protection is governed by the Patents Ordinance, 2000 and the applicable rules. A patent application requires careful technical and legal drafting because the specification and claims define the protection being sought.

Patentability depends on statutory requirements including novelty, inventive step and industrial applicability. The assessment therefore requires more than simply describing that an invention is commercially useful. Existing technology and earlier publications can be relevant to the assessment of novelty and inventive step.

Patent applications can involve technical specifications, drawings, claims, priority documents and examination correspondence. Sindh Lawyer assists applicants with the legal and procedural aspects of patent filing and prosecution before IPO-Pakistan.

Copyright Registration and Protection

Copyright protection is governed by the Copyright Ordinance, 1962. Copyright protection is different from trademark and patent registration because copyright generally concerns original literary, artistic and other protected works rather than brand identity or inventions.

Software, written material, artwork, photographs, recordings and other qualifying creative works may fall within copyright protection depending on the statutory requirements.

Registration or recordal with the Copyright Office can provide documentary evidence concerning the work and claimed ownership. For businesses, maintaining dated source files, agreements, authorship records and assignment documents can also be important when ownership is later disputed.

Industrial Design Registration

The appearance of a product can have commercial value independently of its technical function. Where appropriate, protection for industrial designs may be sought under the Registered Designs Ordinance, 2000.

Design protection can be relevant to the visual appearance of products, packaging and commercially manufactured articles. The filing strategy should be considered before public disclosure where novelty requirements may be relevant.

Trademark Opposition, Cancellation and Infringement

Trademark registration is not necessarily the end of the process. A third party may oppose an application, while an existing registration can become the subject of cancellation or other proceedings on legally recognised grounds.

The Trade Marks Ordinance also recognises earlier rights and preserves certain protection available under the law of passing off and other intellectual property rights.

Where an IP right has been infringed, the appropriate response depends on the nature of the conduct, the right involved, the evidence available and the forum having jurisdiction. Civil remedies may include injunctions and other relief, while particular forms of counterfeiting or piracy may also engage criminal or enforcement provisions.

International Applications and Priority

Businesses operating internationally should consider IP protection country by country. Filing in another country does not automatically create a worldwide Pakistani registration.

Pakistan's participation in international IP arrangements can allow eligible applicants to claim priority from an earlier application in another qualifying country, subject to the applicable convention and statutory requirements. The priority date and filing deadlines therefore need to be handled carefully.

Sindh Lawyer assists Pakistani and foreign applicants with Pakistan-side filings and related documentation.

Documents Required for Trademark, Patent or Copyright Filing

The documents depend on the type of IP right and the applicant's circumstances. A consultation may require:

  • Proposed trademark, logo, brand name or slogan
  • Details of the goods or services for trademark classification
  • Applicant's CNIC, passport or corporate identification documents
  • Company incorporation or business documents, where applicable
  • Details and description of the invention for patent filing
  • Patent drawings, specifications and technical material where applicable
  • Details of an earlier foreign application where a priority claim is being considered
  • Copy of the copyright work or relevant identifying material
  • Evidence of authorship, ownership, assignment or first publication where relevant
  • Details of suspected conflicting marks, designs, patents or unauthorised use
  • Existing registration certificates, examination reports, notices or correspondence

The precise filing requirements should be checked against the applicable IPO-Pakistan procedure before submission.
